Arbitration is the legal process used outside of court where parties present their case, through evidence and legal argument, before a private and impartial third party who decides the merits of their claims and defences.
Arbitration Is
Quick
Arbitration is faster than going to court. Once an arbitrator is selected, depending on the nature and volume of evidence, a hearing can proceed as soon as possible.
Cost Effective
Costs of going to court include court costs which can be very expensive. Contrastingly, costs of arbitration are limited to the fees and expenses of the arbitrator. As in the court process, if parties choose to have lawyers present, the parties are only responsible for their own lawyers’ fees.
Private
Arbitration is a private process while the court is a public process. In arbitration, there will be no resulting public records. This makes arbitration especially suitable for resolving disputes involving sensitive issues or information.
Flexible
In most cases, the parties to an arbitration choose the arbitrator. In court, judges are assigned. And the rules of evidence are less rigid in arbitration than in court. Most types of legal disputes (with the exception of criminal cases) are appropriate for arbitration.
Final
Arbitration provides certainty and finality. In most arbitration cases, the parties agree beforehand to be bound by the arbitrator’s decision. This is unlike the court process, where parties routinely choose to appeal the judge’s decision. A court appeal involves more time and money.
